{"id":2280,"date":"2020-09-25T06:00:32","date_gmt":"2020-09-25T06:00:32","guid":{"rendered":"http:\/\/arakanwatch.org\/?p=2280"},"modified":"2020-09-25T06:09:59","modified_gmt":"2020-09-25T06:09:59","slug":"the-importance-of-land-rights-to-rohingya-repatriation","status":"publish","type":"post","link":"https:\/\/arakanwatch.org\/en\/the-importance-of-land-rights-to-rohingya-repatriation\/","title":{"rendered":"The importance of land rights to Rohingya repatriation"},"content":{"rendered":"<div class=\"ribbon-outer\">\n<h4 class=\"ribbon\">The importance of land rights to Rohingya repatriation<\/h4>\n<\/div>\n<div class=\"excerpt\">\n<p>The Pinheiro Principles and justice for the displaced<\/p>\n<\/div>\n<div class=\"author\"><a href=\"https:\/\/www.policyforum.net\/authors\/farhaan-uddin-ahmed\/\">FARHAAN UDDIN AHMED<\/a><\/div>\n<div class=\"author\">\n<div class=\"post-head\">\n<p class=\"meta\">25 SEPTEMBER 2020<\/p>\n<\/div>\n<div class=\"post-entry\">\n<p><strong>Given widespread confiscation of Rohingya land, it is essential that Myanmar instate changes in property rights to encourage the voluntary return of its displaced Rohingya Muslim community, Farhaan Uddin Ahmed writes.<\/strong><span id=\"more-45409\"><\/span><\/p>\n<p>In August 2017, Myanmar\u2019s military \u2013 the Tatmadaw \u2013 and other actors backed by it initiated a brutal violent campaign of\u00a0<a href=\"https:\/\/www.ohchr.org\/EN\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=22041&amp;LangID=E\">ethnically cleansing<\/a>\u00a0the Rakhine state of Myanmar\u2019s Rohingya community. The atrocities forced more than 800,000 Rohingya people to\u00a0<a href=\"https:\/\/www.abc.net.au\/news\/2020-04-26\/coronavirus-rohingya-covid19-coxs-bazar-refugee-camp\/12167524\">flee<\/a>\u00a0Myanmar, leaving behind their homes and livelihoods and seek refuge in neighbouring Bangladesh.<\/p>\n<p>August 2020 marks three years since these events, which devastated Rohingya communities in Rakhine state. Many now mark 25 August as Rohingya Genocide Memorial Day.<\/p>\n<p>Many argue this campaign of atrocities perpetrated by Myanmar against the Rohingya community was tantamount to genocide and crimes against humanity, and it is now the subject of two separate proceedings in the\u00a0<a href=\"https:\/\/www.icc-cpi.int\/bangladesh-myanmar\">International Criminal Court<\/a>\u00a0and the\u00a0<a href=\"https:\/\/www.icj-cij.org\/en\/case\/178\">International Court of Justice<\/a>.<\/p>\n<p>In March 2017, the UN Human Rights Council established an\u00a0<a href=\"https:\/\/www.ohchr.org\/en\/hrbodies\/hrc\/myanmarffm\/pages\/index.aspx\">Independent International Fact-Finding Mission on Myanmar<\/a>\u00a0to establish the facts and circumstances of the alleged human rights violations and abuses perpetrated by the Tatmadaw and other security forces in Myanmar.<\/p>\n<p>The Mission submitted its\u00a0<a href=\"https:\/\/www.ohchr.org\/EN\/HRBodies\/HRC\/MyanmarFFM\/Pages\/ReportoftheMyanmarFFM.aspx\">first<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.ohchr.org\/EN\/HRBodies\/HRC\/MyanmarFFM\/Pages\/ReportHRC42thSession.aspx\">second<\/a>\u00a0report with detailed findings in September 2018 and 2019. In its reports, the Mission documented in detail the atrocities which have been perpetrated and continue to be perpetrated against the Rohingya community in Rakhine by Myanmar.<\/p>\n<p>Importantly, the Mission\u2019s reports state that the Tatmadaw and other actors supported by it undertook the widespread confiscation and\/or destruction of land, food, livestock, and other possessions belonging to the Rohingya community.<\/p>\n<div class=\"related-article-inline right\">According to the\u00a0<a href=\"https:\/\/www.ohchr.org\/Documents\/HRBodies\/HRCouncil\/FFM-Myanmar\/20190916\/A_HRC_42_CRP.5.pdf\">Mission\u2019s findings<\/a>, in 2018, Myanmar authorities confiscated hundreds of acres of Rohingya farmland, even in those areas which were not affected by the Tatmadaw\u2019s 2017 \u2018clearance operations\u2019 and were still inhabited and used by the Rohingya community.<\/div>\n<p>Moreover, the Mission\u2019s\u00a0<a href=\"https:\/\/reliefweb.int\/sites\/reliefweb.int\/files\/resources\/G1923674.pdf\">2019 report<\/a>\u00a0states that, \u2018the Tatmadaw and ethnic Rakhine continue to prevent farmers from cultivating their lands and deliberately target their sources of food, including by burning paddy fields, confiscating farming and fishing tools, confiscating rice and other food stocks, and deliberately killing or confiscating livestock, such as cows, goats and chickens.\u2019<\/p>\n<p>Myanmar has adopted many measures which aid the large-scale confiscation of land from Rohingya people, and the appropriation of profits from that land into the national budget.<\/p>\n<p>One such measure is the harvesting of untended rice paddies in Rakhine by government personnel in collaboration with private sector companies. In fact, Myanmar has enacted and implemented laws and policies specifically designed to confiscate land belonging to the Rohingya community, such as the recent\u00a0<a href=\"https:\/\/www.burmalibrary.org\/docs25\/2018-09-11-VFV-amendment-en.pdf\">amendment<\/a>\u00a0of the\u00a0<a href=\"https:\/\/www.lift-fund.org\/sites\/lift-fund.org\/files\/uploads\/Vacant,%20Fallow%20.....%20Land%20Law.pdf\">Vacant, Fallow and Virgin Lands Management Act, 2012<\/a>.<\/p>\n<p>The\u00a0<a href=\"https:\/\/documents-dds-ny.un.org\/doc\/UNDOC\/GEN\/G19\/236\/74\/PDF\/G1923674.pdf?OpenElement\">Mission further noted<\/a>\u00a0that the prevailing human rights crisis pertaining to the Rohingya community still living in Rakhine is in large part due to the Myanmar Government\u2019s confiscation and re-appropriation the land inhabited and cultivated by the Rohingya community.<\/p>\n<div class=\"related-article-inline left\">Clearly, the confiscation of land and property belonging to the Rohingya community and denial of their land rights is a major obstacle to the voluntary repatriation of Rohingya refugees from Bangladesh and their rehabilitation in Myanmar. The\u00a0<a href=\"http:\/\/www.theindependentbd.com\/assets\/images\/banner\/linked_file\/20171125094240.pdf\">Arrangement on Return of Displaced Persons from Rakhine State<\/a>\u00a0signed by the governments of Bangladesh and Myanmar in 2017 shows Myanmar\u2019s apparent commitment to this goal:<\/div>\n<p>\u2018Myanmar has agreed to take necessary measures\u2026 to encourage those who had left Myanmar to return voluntarily and safely to their own households and original places of residence or to a safe and secure place nearest to it of their choice. Myanmar will take all possible measures to see that the returnees will not be settled in temporary places for a long period of time\u2026\u2019<\/p>\n<p>It is obvious that all the terms of the Arrangement can be critiqued at length, and the lack of its implementation scrutinised, but just in terms of housing, land and property (HLP) rights, the Arrangement only makes passing reference to them.<\/p>\n<p>It does very little, if anything at all, to remedy the continued denial of HLP rights by Myanmar to the Rohingya community, despite Myanmar\u2019s promise to \u2018take all possible measures\u2019 to encourage the voluntary repatriation of Rohingya refugees.<\/p>\n<p>Without a framework in the Arrangement, Myanmar\u2019s remedial actions should be guided by the 2005 United Nations\u00a0<a href=\"https:\/\/www.unhcr.org\/protection\/idps\/50f94d849\/principles-housing-property-restitution-refugees-displaced-persons-pinheiro.html\">Pinheiro Principles<\/a>\u00a0and the Inter-Agency\u00a0<a href=\"https:\/\/www.ohchr.org\/Documents\/Publications\/pinheiro_principles.pdf\">Handbook on Housing and Property Restitution for Refugees and Displaced Persons<\/a>.<\/p>\n<p>The Pinheiro Principles draw upon existing rights and duties under international human rights law and international humanitarian law, and contextualises them for the restitution of land and property specifically, making them useful in this situation.<\/p>\n<p>They were designed to assist all relevant actors, national and international, in addressing legal and technical issues surrounding HLP rights restitution, in situations where displacement has led to persons being arbitrarily or unlawfully deprived of their former homes, lands, or properties.<\/p>\n<p>T<a href=\"http:\/\/asiapacific.anu.edu.au\/students\/undergrad\/languages\/burmese-0\" target=\"_blank\" rel=\"noopener noreferrer\"><img decoding=\"async\" loading=\"lazy\" class=\"alignright wp-image-37240 size-full\" src=\"https:\/\/www.policyforum.net\/wp-content\/uploads\/2019\/11\/Burmese1-RHS.png\" sizes=\"(max-width: 165px) 100vw, 165px\" srcset=\"https:\/\/www.policyforum.net\/wp-content\/uploads\/2019\/11\/Burmese1-RHS.png 165w, https:\/\/www.policyforum.net\/wp-content\/uploads\/2019\/11\/Burmese1-RHS-57x80.png 57w, https:\/\/www.policyforum.net\/wp-content\/uploads\/2019\/11\/Burmese1-RHS-39x55.png 39w\" alt=\"\" width=\"165\" height=\"230\" \/><\/a>he Principles outline that the implementation of successful HLP restitution programs is a key element of restorative justice, and effectively contributes towards deterring future situations of displacement and building sustainable peace. They should be embraced as part of any program that encourages voluntary repatriation of Rohingya refugees to Myanmar.<\/p>\n<p>If it plans to meet its promises in the Arrangement, it is essential that Myanmar institute a program for the restitution of HLP rights to the Rohingya community in line with the Pinheiro Principles.
